1. Introduction
This Privacy Policy describes how Hypnotik LLC ("we," "us," or "our") handles information in connection with the Hypnotik FX mobile application (the "App"), available on the Google Play Store. The App is a companion application for Hypnotik FX lighting controllers:
- HYPNOTIK FX Audio reactive digital controller (Audio Reactive Pixel Controller [Wi-Fi])
- HYPNOTIK FX 5-in-1 PWM controller (X-Pro Controller [5-in-1, Wi-Fi])
The App is derived from the open-source WLED mobile application (https://github.com/Moustachauve/WLED-Android) Connect your Github account and is used to discover and control Hypnotik FX lighting controllers over a local Wi-Fi network.
2. Information We Do Not Collect
The App does not require user registration, login, or the creation of any account. We do not collect, store, transmit, or process any personal information or personally identifiable information (PII) from users of the App. Specifically, we do not collect names, email addresses, phone numbers, physical addresses, location data, device identifiers, usage analytics, crash reports, cookies, or any other form of personal data.
The App operates entirely on the user's local network to communicate with compatible Hypnotik FX lighting devices. No data is transmitted to our servers or any third-party servers as part of the App's normal operation.
3. Local Network Access
The App requires access to your local Wi-Fi network solely for the purpose of discovering and communicating with Hypnotik FX lighting controllers on the same network. This communication occurs exclusively between the App and the lighting devices on your local network and does not involve any external servers or cloud services.
4. Third-Party Services
The App does not integrate any third-party analytics, advertising, tracking, or data collection services. No data is shared with any third parties.
5. Open-Source Attribution
This App is derived from the WLED mobile application, an open-source project available on GitHub - Moustachauve/WLED-Android: Native Android application for WLED. Because the core architecture is built on this open-source framework, it inherently operates locally without cloud tracking. The full Apache 2.0 license, original copyright notices, and attributions for the WLED project can be found within the App's "About" or "Licenses" menu.
6. Data Security
Since the App does not collect, store, or transmit any personal data, there is no personal data at risk. All communication between the App and your Hypnotik FX lighting devices occurs over your local Wi-Fi network.
7. Children's Privacy
The App does not collect any personal information from any user, including children under the age of 13. We comply with the Children's Online Privacy Protection Act ("COPPA") and similar regulations by virtue of not collecting any data whatsoever.
8. Disclaimer of Liability
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Hypnotik LLC disclaims all liability for any damages, losses, or injuries arising from the use or misuse of the App, including but not limited to improper use of connected lighting hardware, network misconfiguration, unauthorized access to your local network, or any other use of the App that is not in accordance with its intended purpose.
Hypnotik LLC shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use, inability to use, or misuse of the App or any connected hardware products. Users are solely responsible for ensuring the safe and proper use of the App and their connected devices.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Any changes will be reflected by updating the "Effective Date" at the top of this document. We encourage users to review this Privacy Policy periodically. Continued use of the App after any changes constitutes acceptance of the updated Privacy Policy.
